DopaBreak Terms of Use

1. Scope

These Terms govern your use of the DopaBreak application (the "App") provided by Toshiki Sakuraya (the "Operator"). By using the App, you agree to these Terms.

2. What the App does

  1. The App helps you pause for a breath before opening apps such as social media, so that you can choose for yourself how to spend your time on your phone.
  2. Some features rely on Apple's Screen Time frameworks (Family Controls / Device Activity) and on automations you set up in the Shortcuts app. These require your own permission and setup.
  3. "Pro" means the features unlocked by the App's paid plans.

3. Eligibility

  1. If you are a minor, please use the App with the consent of a parent or legal guardian.
  2. You are responsible for providing the device, OS version, and network connection needed to use the App.

4. Paid plans and subscriptions

  1. Prices, billing periods, and free-trial conditions for paid plans are shown on the purchase screen in the App. Current US prices are $9.99/month or $39.99/year. The price shown in the App Store for your region applies.
  2. Payment is processed through Apple's In-App Purchase.
  3. The annual plan includes a 7-day free trial, available only to users who meet Apple's eligibility conditions (such as first-time subscribers). When the trial ends, billing starts automatically unless you cancel.
  4. Subscriptions renew automatically unless canceled.
  5. To cancel, go to your device Settings > your name > Subscriptions at least 24 hours before the renewal date. After canceling, you keep access to paid features until the end of the period you have paid for.
  6. Refunds are handled under Apple's policies. The Operator cannot issue refunds directly.

5. No guarantee of results

  1. The App is a tool that offers a moment of choice. It does not guarantee any outcome, including reduced screen time.
  2. The App is not a medical device and is not intended to diagnose, treat, or prevent addiction or any other condition. If you have concerns about your health, please consult a physician or other professional.

6. Intellectual property

All intellectual property rights in the App and its design, text, and video content belong to the Operator or their rightful owners. You are granted only a non-transferable right to use the App.

7. Prohibited conduct

You must not:

  1. Violate laws or public order and morals
  2. Decompile, reverse engineer, or otherwise analyze the App
  3. Interfere with the operation of the App
  4. Use the App commercially without the Operator's permission
  5. Engage in any other conduct the Operator reasonably deems inappropriate

8. Changes, interruption, and termination of the service

  1. The Operator may change the App's features. Material changes will be announced in the App or by other means.
  2. Some features may become unavailable due to OS changes or events beyond the Operator's control.
  3. If the App is discontinued, reasonable advance notice will be given.

9. Disclaimer and limitation of liability

  1. The Operator does not warrant that the App is complete, accurate, or useful.
  2. Except in cases of willful misconduct or gross negligence, the Operator's liability for damages arising from your use of the App is limited to direct and ordinary damages, and capped at the total fees you paid to the Operator in the preceding 12 months (or JPY 5,000 if you have paid nothing).
  3. Nothing in these Terms limits rights you have under mandatory consumer-protection law.

10. Changes to these Terms

The Operator may amend these Terms when necessary. The effective date and the changes will be announced in advance in the App or on this page. By using the App after the effective date, you accept the amended Terms.

11. Governing law and venue

  1. These Terms are governed by the laws of Japan.
  2. Unless mandatory law provides otherwise, the Tokyo District Court has exclusive jurisdiction in the first instance over disputes relating to the App.

12. Additional terms for the Apple App Store

If you obtained the App from Apple's App Store, the following also applies.

  1. These Terms are a contract between you and the Operator, not with Apple. The Operator, not Apple, is responsible for the App and its content.
  2. The Operator grants you a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the App Store Usage Rules, except that the App may be accessed by other accounts as allowed under Family Sharing or similar rules.
  3. The Operator is solely responsible for maintenance and support of the App. Apple has no obligation to provide any maintenance or support.
  4. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, or liabilities attributable to a failure to conform to a warranty are the Operator's sole responsibility.
  5. The Operator, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection or similar laws.
  6. If a third party claims the App infringes their intellectual property rights, the Operator, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of the claim.
  7. You represent and warrant that you are not located in a country or region subject to a US government embargo, or that has been designated by the US government as a "terrorist supporting" country or region, and that you are not on any US government list of prohibited or restricted parties.
  8. Questions, complaints, and claims regarding the App should be directed to the Operator (Toshiki Sakuraya, email: rebirth.sakuraya@gmail.com). A postal address will be disclosed without delay upon request.
  9. You must comply with applicable third-party terms (such as your carrier agreement) when using the App.
  10. Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
